Restructuring Consultant opportunity!

The Opportunity

The Restructuring Consultant is responsible for meeting with Debtors/Bankrupts, reviewing the information prepared in their file to confirm accuracy, explain the process of the Consumer Proposal or Bankruptcy they are entering into and ensure they understand the duties required of them in order to achieve a successful discharge. Provide Insolvency Counseling as mandated by the Bankruptcy and Insolvency Act (BIA). The incumbent also provides feedback to the Insolvency Solutions Team Lead to enable coaching and to further learning for the Insolvency Solutions Specialist(s). The Restructuring Consultant is also a knowledgeable resource to those coming into their role and/or are in the Trustee Program, providing information on the insolvency process and legislative requirements.
Key Account Responsibilities and Functions

  • Meets with Debtor and Trustee (sign-up meeting)
  • Develops a comfortable conversation and trust with the Debtor
  • Verifies ‘Statement of Affairs’ containing gathered Debtor information
  • Reviews recommended Bankruptcy or Proposal solutions and checks for understanding and Debtor’s readiness to proceed with the process
  • Reviews the payment previously discussed and sets a payment date
  • Goes over the duties of the Debtor (Acknowledgement Statement) as well as other documents
  • Makes sure all signatures are in place(Yours and the Debtor’s)
  • Brings in the Trustee for the assessment (or if requiring the Trustee to assist with a complexity that has arisen)
  • Ensures that the Trustee signs off on documentation.
  • Explains the meaning of a fresh start to the Debtor.
  • Provides a package of documents to the Debtor as per BSI Best Practices
  • E-files documentation to OSB and receives certificate number for registration.
  • E-transfers and couriers documentation to Estate Administration Specialist.
  • Provides financial counseling sessions to assist in rehabilitation in accordance with the Bankruptcy and Insolvency Act (BIA).
  • Arranges first meeting with Debtor to counsel on Money management, Spending and shopping habits, Warning signs of financial difficulty, Obtaining and using credit.
  • Arranges second counseling meeting to review process with Debtor.
  • Ensures adherence to all insolvency solutions policies, procedures and best practices.
  • Ensures alignment to administration processes, documentation and decision-making.
  • Ensures all legal checkpoints (due diligence) are adhered to in compliance with the Bankruptcy and Insolvency Act (BIA).
  • Ensures compliance to ethical and professional requirements as per Office of the Superintendent Bankruptcy Canada (OSB) and the Canadian Association of Insolvency and Restructuring Professionals (CAIRP).
  • Establishes new business relationships through informal marketing and networking, and meets with referral sources i.e. lawyers, schools, social workers, community partners, etc. as mandated
  • Provides counseling both locally and in remote areas, where necessary.
  • Complies with and promotes BSI’s organizational culture and values.
  • Champions and fosters a climate of diversity, respect and inclusion.
  • Provides feedback regarding files, to the Insolvency Solutions Team Lead

Required Skills and Qualifications

  • Be recognized as a qualified BIA Insolvency Counselor
  • Two to three years of experience as Intake Support Specialist and/or
  • Three to five years of Insolvency experience
  • Current enrollment in a CQP Program may be a strong consideration
  • Working knowledge of Microsoft Office suite of products
  • Working knowledge and experience with Insolvency software
  • Strong presentation and communication skills
